Adopting
a child is a wonderful experience. What could be better than getting
a new family member - besides providing a loving home for a child in
need? Unfortunately, it is not usually a simple process and can result
in unnecessary, lengthy delays if not handled
correctly. Is this a private adoption or through an agency? Do you plan
to allow the biological parents to have contact with the child after
the adoption? At Celli, Schlossberg & Friedland, LLC, we have experience with
agency adoptions and private adoptions between third parties, family
members, and step parents. We can also help in drafting agreements between
adoptive and birth parents, in both open and closed adoptions. Our office
is not, however, involved in the actual placement of children for adoption. |

International
adoptions, when handled correctly, can be no more difficult than
adopting a child from within the state. The key thing is to make
sure that it is handled correctly. It is recommended that if you
are planning to adopt a child internationally that you do so through
an approved adoption agency. These agencies are specially trained
to deal with the ins and outs of foreign governments in order to
ensure a smooth transition in the United States. If you are participating
in a private adoption, usually the adoption of a younger family
member, it will be necessary to obtain the consent not only of that
person's parents, if they are still living, but also the government
of that country. Depending on the country, this could be as simple
as notifying the appropriate department in writing, or as complex
as making a personal appearance to state your intentions before
some form of tribunal. It is important to contact your local consulate
to determine what the requirements are for that particular country. |

| Celli, Schlossberg & Friedland, LLC is also delving into new areas of law, including
the recent emergence of Kinship Legal Guardianships. Kinship Legal Guardianship
is a relatively new type of legal guardianship which addresses the needs
of children and caregivers in long-term relationships. This allows a relative
providing long-term care for a child an alternative, permanent placement
arrangement that does not rise to the level of termination of parental
rights, and that is available when adoption is not likely, feasible, or
wanted. |
